Majumder, Advocate. For the Respondent(s) : Mr. Raju Datta, P.P. HON’BLE MR. JUSTICE S. DATTA PURKAYASTHA ORDER 28/01/2026 Heard learned counsel of both sides. During hearing, Mr. Raju Datta, learned P.P. submits that there is a petition for custody trial submitted by the investigating officer in this case which is pending for disposal before the learned Special Judge and meanwhile the Trial Court record has been called for in connection with this case. In view of above circumstances, Mr. Debdas Bakshi, learned counsel submits that he is not pressing the bail application at this stage. However, if the applicant-petitioner is aggrieved by the decision of Special Judge, liberty may be kept reserved for him to approach this Court. Mr. Bakshi, learned counsel also submits that for 170 days he is in custody and therefore, a direction may be given to the Special Judge to expedite the hearing of the petition of the investigating officer. Considered the submission. The Registry is directed to return the Trial Court record by tomorrow (29.01.2026) with copy of this order. The Special Judge is directed to take up the hearing of the petition for custody trial on 30.01.2026. Both the parties are directed to participate in the hearing on that day. The bail application is accordingly disposed of being not pressed at this stage. Pending application(s), if any, shall also stand disposed of.
