SUNDAR (ORDER) [1] Captioned transfer petition has been filed with a prayer to transfer Original Suit No. 27 of 2020/2 of 2025 from the file of ‘learned Civil Judge, Senior Division, Tamenglong, Manipur’ (‘transferor Court’ for convenience) to ‘the Court of learned Civil Judge, Senior Division, Imphal West, Manipur’ (‘transferee Court’ for convenience). Shakir Khan, learned counsel on record for transfer petitioner and Mr. Khumukcham Chinglen Luwang, learned counsel with Enrolment No. 48 of 2020 and Address: Keishamthong Moirang Ningthou Leirak Machin I/W submits that he has instructions to represent the sole respondent and learned counsel very fairly submits that the respondent has no objection for the aforesaid transfer plea. [3] Therefore, the transfer plea in the captioned transfer petition is acceded to by this consent order. [4] Before this Court writes the operative portion of this order, it is deemed appropriate to make clear the following points: i) This order shall not be construed as any negative opinion or reflection on the learned judicial officer of the transferor Court i.e., learned Civil Judge, Senior Division, Tamenglong, Manipur; ii) The transferee Court i.e., the Court of learned Civil Judge, Senior Division, Imphal West, Manipur shall now proceed with the said case (Original Suit No. 27 of 2020/2 of 2025) from the point at which it stands today i.e., the point at which it is being transferred; iii) As this is a consent order, though obvious, it is made clear that this Court has not expressed any view or opinion one way or the other on the grounds raised in the transfer petition. iv) To be noted aforereferred suit that is being transferred was originally on the file of the transferor Court, therefore the transfer plea is more in the nature of a retransfer plea and this is being mentioned solely for the purpose of completion of facts. [5] Civil suit being Original Suit No. 27 of 2020/2 of 2025 now pending on the file of transferor Court i.e., learned Civil Judge, Senior Division, Tamenglong, Manipur shall now stand transferred to the transferee Court i.e., the Court of learned Civil Judge, Senior Division, Imphal West, Manipur forthwith and the transferor Court shall transmit/send all records of the said suit to the transferee Court no sooner than this uploading of this order in official website of this Court (High Court of Manipur). [6] Captioned transfer petition disposed of as allowed vide instant consent order in the aforesaid manner albeit with aforementioned observations and directives. There shall be no order as to costs.
