By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in proceedings arising out of FIR No.237/2025 dated 08.09.2025 registered at PS: Crime Branch under Sections 351(3)/238/ 75(3)/79 of the Bharatiya Nyaya Sanhita, 2023 (BNS). 2. Succinctly put, as per prosecution, the FIR was registered at the instance of the prosecutrix who received explicit death threats and obscene abuses on the social media portal Instagram from one Instagram account by the name of ‘Celebrity Killer’, both through public comments on her posts and privately through direct messages. During the course of investigation, on the basis of technical information received from META, the parent platform of Instagram, the applicant was identified as the user This is a digitally signed order. It was further found from his devices that the applicant had sent sexually coloured abuses and death threats to numerous other Instagram users from his above account as well. 3. In these facts, this Court has heard learned counsel for the applicant as well as learned APP. Status Report handed over by learned APP is also taken on record. 4. Though the applicant claims to be in a state of intoxication at the alleged time of sending the messages involved in the present FIR, however, the same does not hold much water since it was evidently not a one-time instance, and as he had been repeatedly sending death threats and sexually abusive content to other Instagram users time and again as well. 5. Further, record reflects that the applicant had allegedly also posted pictures and shown his presence at the very same place where the prosecutrix is also working. 6. Additionally, since there are as many as eight witnesses have been mentioned in the charge-sheet and the matter is currently at the stage of framing of charges, it raises a strong apprehension of witness intimidation and evidence tampering if the applicant is enlarged on bail at this stage. 7.
