No.8656 of 2026 PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the respondents to permit the petitioner to redeem the pledged 17 sovereigns of gold jewels in the Vishnampet Primary Agricultural Co-operative Credit Society, Vishnampet, Thanjavur District, on payment of the actual outstanding loan amount, and in the event the said jewels are not available or have been unlawfully dealt with, direct the respondents to pay the present market value of the said jewels to the petitioner, and further direct the respondents 1 to 3 to initiate appropriate disciplinary proceedings and criminal action against the Secretary of the 4th respondent Society, For Petitioner : Mr.T.Wins For R1 to R3 : M/s.P.B.Ahamad Yasmin Parvin Government Advocate ORDER This writ petition is filed directing the respondents to permit the petitioner to redeem the pledged 17 sovereigns of gold jewels in the Vishnampet Primary Agricultural Co-operative Credit Society, Thanjavur District. 2. Upon considering the case of the petitioner, it is the case of the petitioner that the said Co-operative Society wrongfully sold the jewels of the petitioner and not even the details are furnished. The petitioner 2/6 https://www.mhc.tn.gov.in/judis WP(MD). No.8656 of 2026 was ready to redeem the jewels, when earlier the matter the auction notice was published. However, the auction was postponed and thinking that the loan will be waived, the petitioner did not pay the balance outstanding. Thereafter, without any further notice, the jewels seemed to have been auctioned. Therefore, the petitioner is aggrieved by the fact that the jewels have been wrongfully sold and therefore he seeks an action against the fourth respondent Society. 3. On a perusal of the allegations made, it can be seen that even the allegations are made with reference only to the 4th respondent Society. The 4th respondent is a Co-operative Society and in view of the judgment of the Larger Bench of this Court in K.Marapppan vs. the Deputy Registrar of Co-operative Society, Namakkal Circle, Namakkal, [2006 (4) CTC 689], the writ petition as against the fourth respondent is not maintainable. 4. If the petitioner wants to invoke the jurisdiction of respondents 1 to 3, the petitioner has to approach by appropriate statutory 3/6 https://www.mhc.tn.gov.in/judis WP(MD). No.8656 of 2026 proceedings under Section 90 of the Tamil Nadu Co-operative Societies Act. In the present case, there is no jurisdiction for the respondents 1 to 3 in interfering with the business of the fourth respondent Society since the petitioner has not approached by appropriate statutory proceedings under Section 90 of the Tamil Nadu Co-operative Societies Act. 5. Therefore, keeping open the liberty of the petitioner to initiate appropriate statutory proceedings or at the option of the petitioner to approach the appropriate civil forum, the prayer in the writ petition as such cannot be countenanced. 5. In view thereof keeping open the liberty of the petitioner to raise a dispute under Section 90 of the Tamil Nadu Co-operative Societies Act or to approach the competent civil forum, this writ petition stands disposed of.
