Heard Ms. Chetna Sharma, learned counsel for the petitioner. Also heard Mr. S.S. Baghel, learned Government Advocate, appearing for the State/respondents No. 1 to 3. 2. The present petition has been filed by the petitioner with the following prayers: “1. Hon’ble Court may be pleased to call for the records of the case related to Crime No. 322 of 2024 P.S. Urga, Korba, District Korba (C.G.) 2. Hon’ble Court may be pleased to quash the final report and charge-sheet in Crime No. 0322 of 2024 registered by police station, Urga, Korba, District Korba filed on 26.11.2024 before Judicial Magistrate First Class, Korba (C.G.) in Cr. Case No. 4036 of 2024 (Annexure P/1) 3. The Hon’ble Court may kindly be pleased to set aside the order of taking cognizance dated 26.11.2024 in Cr. Case No. 4036 of 2024 (Annexure P/2) and all consequential proceedings emanating from Crime No. 0322 of 2024 against the petitioner or any other order 3 that Hon’ble Court deems fit to be passed, in the interest of justice. 4. Hon’ble Court may be pleased to grant the cost of the entire petition from the respondents. 5. Hon’ble Court may be pleased to grant any other relief which deems fit and proper in the facts and circumstances of the case.” 3. Upon perusal of the prayer clause in the present petition, it appears that the petition has been drafted with a defective prayer. We are, therefore, not inclined to entertain the petition in its present form, as the prayer is vague and sketchy and does not disclose the offences for which the impugned FIR has been registered or the charge-sheet filed before the competent Court. At this stage, learned counsel for the petitioner seeks permission to withdraw the petition with liberty to file a fresh petition containing an appropriate and complete prayer. 4. Learned State Counsel has no objection to the same. 5. In view of the submission made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, subject to the petitioner depositing a sum of Rs.2,000/- as costs before the Registry of this Court. The receipt of such deposit shall be submitted at the time of filing the fresh petition, if any. The amount so deposited shall be transmitted to the Government Disabled College, Mana Camp, Raipur (C.G.). 4 6. Certified copies of the documents annexed to the petition, if any, may be returned to learned counsel for the petitioner after retaining photocopies on record.
