The Petitioners were initially appointed as NMRs in Andhra Pradesh State Co-operative Rural Irrigation Corporation (‘APSCRIC’) and their services were regularized in the cadre of Office Subordinates. Pursuant to issuance of G.O.Ms.No.24, dated 09.01.2002, framing certain guidelines for absorption of surplus staff in various Government undertakings in the vacant posts of the Government Department, the Petitioners were absorbed in the Office of District Employment Exchange, Anantapur and Chittoor. 3. While so, the Government had issued G.O.Ms.No.180, Finance (HR.I.PLG.Policy), Department dated 25.10.2017 for repatriating all the absorbed surplus employees to their parent organizations from Government Departments and pursuant to the same, Petitioners were sought to be repatriated. Questioning the same, Petitioners herein approached this Court by filing W.P.No.36354 of 2017 and this Court passed interim orders of status quo to be maintained on 31.10.2017. In compliance of the orders, the Petitioners are continuing in the departments and they were absorbed. Thereafter, the age of superannuation was enhanced to 60 years by the State 17 Government by amending the governing Act and also issued G.O.Ms.No.138, dated 08.08.2017 extending the benefit to the employees of the State controlled entities specified in Schedule IX and X of the A.P. Reorganization Act, 2014. As the benefit of enhanced age of superannuation upto 60 years as it was then, was not being extended to the Petitioners, writ petitions were filed before this Court, which were disposed of with a direction to continue them till they attain 60 years. 4. Subsequently, an amendment was brought in to the Andhra Pradesh Public Employment (Regulation of age of Superannuation) (Amendment) Ordinance, 2022 enhancing the age of superannuation from 60 to 62 years vide G.O.Ms.No.15, Finance (HR.IV-FR & LR) Department, dated 31.01.2022 by amending to the Andhra Pradesh Public Employment (Regulation of Age of Superannuation) Act, 1984. The benefit was extended to the employees of State controlled entities named in Schedule IX & X of the A.P. Reorganization Act, 2014 vide G.O.Ms.No.45 Finance (HR.IV-FRR & LR) Department, dated 02.07.2026. These batch of writ petitions were filed prior to the G.O.Ms.No.45 as well as after issuance on the premise that Petitioners were sought to be superannuated. 5. This Court taking note of the fact that they were absorbed into Government departments and the status quo order in W.P.No.36354 of 2017 passed interim orders to continue the Petitioners till they attain the age of 62 years. 18 6. Sri. M.Vijay Kumar, learned Senior Counsel would submit that though interim orders were passed by this Court, there was delay in compliance as regards some of the Petitioners. It is further submitted that compliance was only on account of contempt cases filed by some of the Petitioners, but salaries were not paid. Learned Assistant Government Pleader for Services-II would submit that this issue would be examined. 7. As mentioned above, the services of the Petitioners were regularized in Andhra Pradesh State Co-operative Rural Irrigation Corporation (APSCRIC) and since they were treated to be surplus, they were absorbed in Government departments pursuant to G.O.Ms.No.24, dated 24.01.2002. On absorption, the status of the Petitioners altered to that of a Government employee. However, the Petitioners were sought to be repatriated pursuant to G.O.Ms.No.180, Finance (HR.I.PLG.Policy), Department dated 25.10.2017 and this Court, in W.P.No.36354 of 2017 filed questioning the same, passed interim order of status quo on 31.10.2017. 8. By virtue of the interim orders, the status of the Petitioners continued as Government employee and their services should have continued till 62 years having due regard to the interim orders in W.P.No.36354 of 2017. The authorities being what they are, again sought to terminate the services of the Petitioners on attaining the age of 60 years. The contemptuous action of the authorities led to the filing of the present batch of cases. Be that as it may, the Petitioners being government employees as on date and in view of interim orders in W.P.No.36354 of 2017 are entitled to be continued till 62 years. 19 9. In view of the same, the writ petitions are disposed of with the following directions: (i) The Petitioners shall be continued till they attain the age of 62 years; (ii) The Petitioners shall be paid salaries from the date of interim orders granted by this Court. (iii)There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 07.10.2026 KLP/VSR
