JUSTICE SANDEEP TANEJA Order 06/08/2026 This writ petition has been filed by the petitioner with the following prayers:- “It is therefore, humbly prayed that this Hon'ble Court may be pleased to:- (i) Prohibit Mobile DJs/vehicle-mounted loudspeakers across the city of Jaipur and Rajasthan, in compliance with the District Collector's Order dated 20.11.2019. [2026:RJ-JP:30964-DB] (2 of 4) [CW-17326/2025] (ii) Ensure strict prohibition of loudspeakers/amplifiers mounted upon Mobile Djs/ Dj vehicles between 10 PM - 6 AM and make sure that compliance is being made in respect of Noise Pollution Rules, 2000. (iii) Direct the respondent authorities to equip every police station with noise meters; directions may be given to conduct random checks and seize equipment exceeding 75 dB limit. (iv) Fix responsibility of SHO / SDM concerned may be given for any violation in their jurisdiction and to treat its failure as dereliction of duty. (v) Launch online portal / helpline for noise complaints and to publish monthly action reports for Steps taken since earlier representations, Number of Mobile DJs seized, FIRs lodged, prosecutions initiated, Equipment procured for decibel monitoring and action plan for future compliance. (vi) Run campaigns sensitizing citizens, DJ owners, and procession organisers about limits and penalties and action to be taken against the offenders. (vii) Such further relief for which the petitioners are entitled may also be awarded in the facts and circumstances of the case including cost of the petition.” The respondents have filed an additional affidavit in response to the writ petition filed by the petitioner. In paragraphs 4 and 6 of the said additional affidavit, the respondents have stated as under:- “4. That the status of enforcement action undetaken during the year 2026 (up to 20.06.2026) is as under:- Sr. No. Action Statutory Provisions Action Taken (up to 20.06.2026) Objective 1. Seizure of Illegal DJ Vehicles Motor Vehicles Act, 1988, the Rajasthan Noise Control Act, 1963, the Noise Pollution (Regulation and Control) Rules, 2000, and other applicable legal provisions. 47 DJ Vehicles Seized To immediately prevent further illegal operation of vehicle-mounted DJ systems and ensure compliance with statutory requirements. 3. Enforceme nt Action by Traffic Police Motor Vehicles Act, 1988 and the Rules framed thereunder. 580 Enforcement Actions /Challans Action against vehicles and drivers violating traffic regulations, unauthorised modifications, use of prohibited sound systems and other violations contributing to noise pollution. 4. Enforceme nt Action by Jaipur Police Motor Vehicles Act, 1988, the Bharatiya Nyaya Sanhita, 2023, and other applicable statutory provisions. 625 Enforcement Actions Action against persons causing noise pollution and public nuisance through illegal use of loudspeakers, pressure horns, modified vehicles and other prohibited acts. 5. Public Awareness & Communit y Outreach Programm es Preventive policing measures undertaken under the Rajasthan Police Act, 2007, read with the Noise Pollution (Regulation and Control) Rules, 2000, and executive directions issued by the competent authorities. 15 Awareness Programmes Conducted, 1,360 Citizens Counselled and Sensitised To create public awareness regarding permissible noise limits, legal requirements for the use of loudspeakers and DJ systems, consequences of violations, and to promote voluntary compliance with the law. That the answering respondents respectfully submit that enforcement action against illegal DJ vehicles and other sources of noise pollution is undertaken on a continuous basis through regular patrolling, special enforcement drives and upon receipt of complaints from members of the public. Whenever any violation is detected or brought to the notice of the Police, prompt action is initiated in accordance with the applicable statutory provisions, depending upon the facts and circumstances of each case.” Heard learned counsel for the parties and perused the record. After considering the averments made by the respondents in their additional affidavit, we are satisfied that the respondents have taken appropriate steps to control the operation of illegal DJ vehicles, vehicle-mounted loudspeakers and other sources of noise pollution. In view of the above, the present Public Interest Litigation (PIL) petition stands disposed of. All pending applications, if any, also stand disposed of.
