Accused Ram Milan Singh further stated that the side of the first informant chased his brother on which he and others ran to save on which they were also assaulted. 23. Accused Babu Singh further stated that Ram Roop was grazing his cattle in the land of Gram Samaj. Nand Lal Singh tried to stop him by stating that the land belongs to him. Ram Roop then stated that the land was of Gram Samaj. He further states that Sukhraj Singh, Nand Lal Singh, Ram Nazar Singh, Surya Kumar and Jwala Prasad then chased Ram Roop on which they objected that the land is go Gram Samaj. He was assaulted and thrown down. He shouted. Lakhan Darji and Bhanu Pratap who were also grazing their animals reached there who were having lathis with them. The accused Babu Singh had filed three papers in defence being the certified copy of first information report lodged by 9 CRLA No. - 230 of 1983 Ram Milan Singh as Exb: Kha-1, the injury reports of accused Ram Milan Singh and Babu Singh as Exb: Kha-2 & 3 respectively. 24. The trial court thus finding the case of the prosecution to be beyond reasonable doubt convicted and sentenced the accused-appellants as above. 25. Heard Sri Rahul Pandey, learned counsel for the appellants and Sri Ajay Singh, learned A.G.A.-I for the State and perused the record. The trial court record are also tagged with this file which have also been perused. The paper-book of the matter is also prepared which has also been perused. 26. Learned counsel for the appellant submitted that the appellant has been falsely implicated in the present case. It is submitted that the present incident has occurred at the spur of moment of challenge by both the sides. It is submitted that from the side of defence also a first information report was lodged and two persons namely Ram Milan Singh and Babu Singh who are accused in the present matter received injuries. It is submitted that the present case is a case where the accused were told not to graze their animals in the field. They stated that the same is of Gram Samaj and indulged in assault on the accused and the accused also assaulted them which was as a result of a free-fight between the parties. It is submitted that although the prosecution has stated in the first information report about the said two accused receiving injuries but the said version is not reliable in as much as the incident was of a free-fight in which common & general role was assigned to all the accused and no specification was given. It is submitted that thus looking to the same and also the facts that despite Ram Milan Singh and Babu Singh receiving injuries as per the evidence of Sukhram Singh the said case ended in an acquittal. It is a fit case where benefit of doubt be extended to the accused-appellants and they be acquitted of the charges levelled against them. 27. Per contra, learned counsel for the State opposed the appeal and submissions of learned counsel for the appellants and submitted that the 10 CRLA No. - 230 of 1983 prosecution has proved its case beyond reasonable doubt and the defence version as per the first information report was found to be incorrect and thus the said case ended in an acquittal and thus the prosecution in the present case is totally truthful and reliable and beyond any reasonable doubt. The appeal thus be dismissed. 28. After having heard learned counsel for the parties and perusing the records, it is evident that the dispute in the present matter arose in the field between the parties at the time of grazing of the animals. In the present matter two accused namely Ram Milan Singh and Babu Singh have also received injuries. A first information report was lodged on 22.08.1975 by Ram Milan Singh which has been exhibited as Exb: Kha-1 to the records. Although the said matter ended in an acquittal but the version therein was of the informant and his side assaulting the side of the accused in which Ram Milan Singh and Babu Singh received injuries. The injury reports of both the said injuries have been filed as Exb: Kha-2 & 3 respectively. General and omnibus allegations have been levelled against all the accused being a total of seven in number in the first information report. Both the sides have received injuries. There is no specification of the roles of the accused. The injured Nand Lal Singh was found to have received 09 injuries on his person out of which injury nos. 8 & 9 were opined to be simple in nature and rest of the injuries were opined to be kept under observation and advised for X-Ray and further treatment. He was unconscious. There is nothing on record to show regarding any further probing of the said injuries, any such X-Ray examination or any such supplementary medical examination report of the said injured. P.W.-5 Dr. V.P. Singh who conducted his medical examination also did not state of any such further medical examination of the said injured in pursuance of the advise given by him at the time of his medical examination. There is no other witness examined to show any such further medical examination of the said injured. Thus the nature of the remaining injuries cannot be deciphered and there was nothing on record to show as to what was their nature. The present case was in the fields while the accused were grazing their animals. It appears to be a 11 CRLA No. - 230 of 1983 case of free-fight. Although the prosecution in the first information report has explained the injuries of the two accused but the fact remains that there was a defence version also by them for which a first information report was lodged. No specification of the role has been assigned to them. In view of the same it would be in the fitness of things that benefit of doubt be extended to them. This Court thus while extending the benefit of doubt acquits the surviving accused-appellants. 29. Non-bailable warrants were issued against the accused-appellants- Ram Milan Singh and Nanhua vide orders dated 24.08.2026. As per the office report dated 21.09.2026 it is reported by the Chief Judicial Magistrate, Fatehpur vide letter dated 14.09.2026 that the accused- appellant Nanuha has been arrested and sent to District Jail, Fatehpur. Further as per the office report dated 21.09.2026 the Chief Judicial Magistrate, Fatehpur vide letter dated 16.09.2026 has reported that the accused-appellant Ram Milan Singh has been arrested and sent to District Jail, Fatehpur. 30. Thus both the accused-appellants are in jail. They shall be released forthwith unless wanted in any other case. 31. The judgment and order dated 24.01.1983 passed by the Additional Sessions Judge (Special Judge), Fatehpur is set-aside. 32. The appeals are allowed. 33. A copy of this judgment along with the trial court record be sent to the court concerned forthwith for communication and necessary action. 34. Pending application (s), if any, shall stand disposed of. October 07, 2026 AS Rathore (Samit Gopal,J.) Digitally signed by :- ABHISHEK SINGH RATHOR High Court of Judicature at Allahabad
