The petitioner has filed the present writ petition challenging the awards dated 06.04.2022 and 23.06.2022, whereby the compensation awarded to him in respect of his land bearing Khasra No. 29/1, situated at Village Kuagaon, Tahsil and District KISHORE KUMAR DESHMUKH Digitally signed by KISHORE KUMAR DESHMUKH Date: 2026.01.13 18:23:20 +0530
Mungeli (C.G.), admeasuring 0.437 hectare, acquired for the purpose of construction of National Highway No. 130A, has been reduced by treating the land as non-irrigated. 2. Learned counsel for the petitioner would submit that the original award was passed on 28.02.2020. Thereafter, the respondent authorities reviewed the award and enhanced the compensation by order dated 11.10.2021. Subsequently, by order dated 06.04.2022, the respondents cancelled the enhanced award dated 11.10.2021 and restored the original award vide award dated 23.06.2022. 3. On the other hand, learned Government Advocate for the State would submit that the petitioner is essentially seeking enhancement of compensation, and therefore, the present writ petition is not maintainable. He would further submit that the petitioner has an efficacious remedy under Section 3G(5) of the National Highways Act, 1956. The National Highways Authority of India has already appointed the Commissioner, Bilaspur as the Sole Arbitrator under the said provision to adjudicate disputes relating to the validity and quantum of the award. 4. In view of the aforesaid submissions, this Court is of the considered opinion that the present writ petition, at this stage, is not maintainable.
However, liberty is granted to the petitioner to avail the remedy available to him under the National Highways Act, 1956, wherein he shall be at liberty to raise all permissible grounds and place on record all relevant documents in support of his claim. Page 3 of 3
