Mishra, Advocate For the State : Mr. Rajesh Kumar, APP …...... 03 /08.05.2026: This bail application has been filed by the petitioners under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 338, 336(2), 340(2), 341(3), 274, 275, 317(5), 3(5) of the Bharatiya Nyaya Sanhita and Section 47(a) of the Excise Act. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. It is alleged that foreign liquor was recovered from the vehicle in which the petitioners were sitting. The bail of these petitioners was earlier rejected by this Court. Now chargesheet has already been submitted and charge has also been framed. 5. The petitioners are in custody since 23.11.2025. 6. Considering the fact that charge has been framed, I am inclined to grant bail to the petitioners. Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) 2026:JHHC:13818 2 each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Hazaribag, Jharkhand in connection with Chauparan PS Case No. 323 of 2025 corresponding to GR Case No. 263 of 2026 subject to the condition that one of the bailors should be a close relative of the petitioners, having sufficient landed property in his/her own name within the State of Jharkhand. 7.
