2. The petitioner is apprehending his arrest in connection with Govindpur P.S. Case No.42 of 2026, for the alleged offences registered under Sections 126(2), 127(2), 115(2), 132, 351(2), 352, 324(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned J.M. 1st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that the petitioner himself is an employee of Jharkhand Bijli Vitran Nitam Limited and the allegations are made that when the raiding team of the said Nigam raided in a village the villagers have indulged in altercation and they have made hooliganism. He further submits that in light of Annexure-2 it is clear that the petitioner is working in Jharkhand Bijli Vitran Nitam Limited and he was also the member of raiding team. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.20 of the petition. He next submits that in

identical situation co-accused persons have already been granted anticipatory bail in A.B.A. No.1895 of 2026.

Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of involving in unlawful assembly.

Considering that in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid A.B.A. and Annexure-2 is a document which prima facie suggest that the petitioner himself is an employee of Jharkhand Bijli Vitran Nitam Limited and it has been pointed out that the petitioner was also the member of raiding team and further the petitioner has got no criminal antecedent as disclosed in paragraph No.20 of the petition, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned J.M. 1st Class, Dhanbad in connection with Govindpur P.S. Case No.42 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
