Medhi, learned counsel for the petitioner and Mr. B. Sarma, learned Addl. Public Prosecutor, Assam, appearing for the State respondent. This is an application under Section 483 of the BNSS, 2023 for granting regular bail to the petitioner, namely, Bidyut Buragohain, in connection with Dhemaji P.S. Case No. 59/2026 registered under Sections 61(2)/ 308(4) of the BNS, 2023 read with Sections 10/13 of the Unlawful Activities (Prevention) Page No.# 2/3 Act, 1967 who was arrested on 24.04.2026. The allegation as reflected in the FIR is that on 26.03.2026, an FIR was lodged at Dhemaji P.S by the complainant stating that he has conducted an enquiry in connection with the referred complaint. During the course of enquiry, he had examined the victims namely Sri - Dinesh Goel, Sri Dayal Sarkar, and Sri Prabin Jaiswal, and recorded their statements. During examination, they have stated that, they had received extortion related money demand letters from Major Abhimanyu Asom, Assistant Finance Secretary, ULFA (I) and Lt. General Michael Asom, Finance Secretary, ULFA (I) in-order to-raise funds for their organization. Among the said persons, Sri Dinesh Goel (Unnati Enterprise), Sri Dayal Sarkar (Maa Hardware), and Sri Prabin Jaiswal (Maa Vaishno Food & Beverages and Maa Vaishno Udyog) received extortion demand letters of Rs. 7,00,000/- on 21.03.2026, Rs. 15,00,000/- on 04.03.2026, and Rs. 15,00,000/- on 18.01.2026, respectively. The extortion demand letters received by them were also scrutinized. It is further revealed that, apart from the demand letters, the said businessmen have been repeatedly threatened through WhatsApp calls from the mobile numbers 9366877918, 6009488182, 6009489895, 6009687701, 6009126916, 6009624401, and 9612783922, wherein they were warned that failure to pay the demanded amounts at the earliest would result in killing them and their family members. At the conclusion of the preliminary enquiry, it has been established that the businessmen Sri Dinesh Goel, Sri Dayal Sarkar, and Sri Prabin Jaiswal were subjected to extortion demands, allegedly issued in the ULFA (I) pad by two persons suspected to be cadres of ULFA (I), namely Major Abhimanyu Asom, Assistant Finance Secretary, ULFA (I), and Lt. General Michael Asom, Finance Secretary, ULFA (I). It was also suspected that some local active collaborators (on-ground worker) may be involved in facilitating such extortion Page No.# 3/3 activities. After receipt of the said complaint, the Officer-in-Charge, Dhemaji Police Station, registered a case vide Dhemaji P.S Case No.59/2026 under Section 61(2)/308(4) of BNS,2023 r/w 10/13 of UAP Act. Hence, the present bail application. The learned counsel for the petitioner submits that the petitioner is not in any way associated with the alleged activities of any ban organization and he belongs to a respectable family and considering the period of detention, the prayer for bail may be allowed. The learned Addl. P.P. has produced the case diary wherefrom incriminating material is available connecting him with the extortion activities of underground organization. Furthermore, the provisions of U.A.(P) Act are also incorporated in the FIR. Having regard to the material available in the case dairy, the prayer for bail is rejected at this stage.
