Namkum, District Ranchi, Jharkhand. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Shubham Mishra, Advocate For the Respondent(s): Mr. Sushant Kumar, AC to SC-II Mr. Sanjoy Piprawall, Advocate Mr. Prince Kumar, Advocate Mr. Rakesh Ranjan, Advocate 2026:JHHC:8771 2 Mr. Jay Prakash, Advocate ------ 04/ 25.03.2026 By filing this writ petition, the petitioners have prayed for the following reliefs :- “For a direction upon the respondents to immediately and forthwith appoint the petitioners on the post of Assistant Teacher in Class VI to VIII in the subject of Social Science in their respective categories pursuant to Jharkhand Trained Primary Teacher Combined Competitive Examination 2023 as the petitioners participated in the said examination and after being successful, appeared in the document verification and no objection was raised during the document verification but their names were not included in the final merit list in spite of the fact that the seats are still lying vacant and the respondent authorities without comparing the merit of the candidates as reflected at the recruitment test arbitrarily restricted to a few candidates notwithstanding the number of vacancies and the availability of qualified candidates.” 2. Heard learned counsel representing the petitioners and learned counsel representing the respondents. 3. After hearing the parties and going through the records, I find that the petitioners applied for the post of Trained Graduate Teacher (TGT) (Class-VI to VIII), pursuant to Advertisement No.13/2023, under their respective categories. 4. During the course of argument, at the outset learned counsel representing the respondent – JSSC, submits that petitioner No.2 – Anand Kumar Dangi, has already been selected. 2026:JHHC:8771 3 5. Since petitioner No.2 – Anand Kumar Dangi, has already been selected, it is expected that the State will issue appointment letter to petitioner No.2 – Anand Kumar Dangi, if he is otherwise found fit. 6. So far as petitioner No.6 - Heena Farheen, is concerned, she belongs to Unreserved category and she has obtained 301.42430180 marks and the last selected candidate as per the State wise merit list has admittedly obtained 260.06281925 marks, which is lesser marks than the petitioner. 7. Thus, if petitioner No.6 - Heena Farheen is otherwise eligible, her case needs consideration by the JSSC. Further, since petitioner No.6 is of Unreserved category, there is no question of migration to any other category also. The respondents will take a decision in respect of this petitioner and communicate the same to petitioner No.6, within four weeks from the date of receipt of copy of this order. If the order passed is in favour of the petitioner No.6, the JSSC will act accordingly, recommending the name of petitioner No.6. If the claim of petitioner No.6 is turned down for any lawful reason, the same should be communicated to the her within the aforesaid period. 8. So far as petitioner No.1 - Dewanand Uranw, is concerned, he has obtained 202.14198792 marks in his category and subject, whereas the last selected candidate as per the State wise merit list has obtained 204.18292126 marks in the category and subject of petitioner No.1. 9. So far as petitioner No.3 - Md. Parwez Alam, is concerned, 2026:JHHC:8771 4 he has obtained 282.16338514 in EBC-I category, whereas the last selected candidate as per the State wise merit list has obtained 283.284749004 marks in the category and subject of petitioner No.3. 10. So far as petitioner No.4 - Sanjay Kumar Ohdar, is concerned, he has obtained 267.00699127 in EBC-I category, whereas the last selected candidate as per the State wise merit list has obtained 283.284749004 marks in the category and subject of petitioner No.4. 11. So far as petitioner No.5 - Minakshi Sheshadri, is concerned, she has obtained 257.32636191 in BC-II category, whereas the last selected candidate as per the State wise merit list has obtained 260.06281925 marks in the category and subject of petitioner No.5. 12. So far as petitioner No.7 - Manoj Kumar Das, is concerned, he has obtained 134.34404470 in SC category, whereas the last selected candidate as per the State wise merit list has obtained 151.17239955 marks in the category and subject of petitioner No.7. 13. Since petitioner Nos.1, 3, 4, 5 and 7 have obtained much lesser marks than the last selected candidates in the category and subject of these petitioners, I am of the opinion that no relief can be granted to petitioner Nos.1, 3, 4, 5 and 7. 14. However, since it has been admitted that the appointment process is still continuing, be it noted that if in future, it is found that any person/s obtaining lesser marks than petitioner Nos.1, 3, 4, 5 2026:JHHC:8771 5 and 7, in the category and subject of the petitioner Nos.1, 3, 4, 5 and 7 as per the State wise merit list, has / have been appointed, it will be open to petitioner Nos.1, 3, 4, 5 and 7 to approach the respondent - JSSC by filing a representation showing proof that the person/s having lesser marks has / have been appointed. In that event, the JSSC will consider the case of petitioner Nos.1, 3, 4, 5 and 7 and pass appropriate order. 15. With the aforesaid observation and direction, this writ petition stands disposed of.
