Public Prosecutor, Assam for the State respondent. 2. This is an application under Section 482 of BNSS, 2023 for granting pre- arrest bail to the petitioner, namely Shairuf Alom, apprehending arrest in connection with Murajhar P.S. Case No. 115/2025 registered Sections 61(2)/ 316(2)/ 318(4)/ 308(4) of the BNS, 2023. Page No.# 2/3

The allegations made against the petitioner is that on 27-06-2025 one Jahir Alom lodged an FIR before the Officer-in-charge of Murajhar Police Station alleging that on 24-05-2025 a friend of his namely Shairul Alom, takes him to Guwahati to rent a car from Vrindavan Tours & Travels. Thereafter, due to anomalies in Shairul's documents the documents of the informant were submitted to rent a Baleno Car bearing registration no. AS01 FA 8500 and it was taken to the house of the accused person. The car was kept for a week at the house of the accused person and after they had secretly planned to sell the car it was kept in the house of accused no. 2. On the other side, when the owner of the car called the informant and pressurized to hand over the car, the informant asked the accused no. 1 to return the car but still the accused person threatened him and asked money stating that the car was on rent in the name of the informant and thus being helpless, he gave cash of Rs. 50,000/- and Rs. 70,000/-online to the accused person but even thereafter the accused person did not return the car and when they demanded another Rs. 50,000/- he informed the police and the police recovered the car from the house of the accused no. 2 and hence the case. 4.
In course of investigation, two of the accused persons were arrested and subsequently they were released on bail. 5. Pursuant to the interim protection granted by this court, it is submitted that the petitioner has appeared before the I.O. and his statement has been recorded. It is also submitted that the vehicle in question has been recovered and handed to the owner. Investigation of the case is complete and charge sheet has also been submitted. 6. Having regard to the above, it would not be necessary to take the petitioner in custody at this stage. Accordingly, prayer for bail is allowed. The
Page No.# 3/3 interim order dated 18.05.2026 is hereby made absolute, subject to the conditions that the petitioner shall regularly participate in the trial, if and when one commences. 7. The bail application is accordingly disposed of
