1. Heard Mr. K. Singha, the learned counsel for the petitioner. Also heard Mr. S. K. Ghosh, the
learned counsel for the caveator/respondent.
2. This application under Article 227 of the Constitution of India has been field by the petitioners, impugning the order dated 12.08.2026 passed by the Court of the learned Civil Judge (Senior Division), Nagaon, in Misc Appeal No. 12/2026 whereby the interim stay granted on 29.07.2026 of further proceeding of the Title Execution Case No. 5/2025 was vacated.
3. Mr. S. K. Ghosh, the learned counsel for the respondent submits that since the Misc. Appeal No. 12/2026 is fixed for hearing on 31.08.2026 and since both the parties have already appeared before the Appellate Court, he has no objection if this Revision Petition is
disposed of with a direction to the Appellate Court to dispose of the appeal expeditiously.
4. In view of the submissions made by the learned counsel for the respondent, this CRP(IO) is disposed of with a direction to the Appellate Court of Civil Judge (Senior Division), Nagaon, that it
Page No.# 3/3 shall dispose of the Misc Appeal No. 12/2026 as expeditiously as possible, preferably within a period of one month from the date of this order.
5. Till then the further proceeding of Title Execution Case No. 5/2025 shall remain stayed.
