This is first bail application filed under Section 483 of the Bhartiya Nagrik Suraksha Sanhita 2023 for grant of regular bail to applicants, who have been arrested in connection with Crime No.1107/2025, registered at PS -Civil Line, Bilaspur (C.G.), for commission of offence punishable under Sections 74, 351(2), 3(5) of the BNS; Sections 7 & 8 of the POCSO Act as per Charge-sheet. However, charges are framed under Sections 351(3), 115(2) and 296 of BNS. 2. Case of prosecution, in brief, is that on 22.09.2025, applicants alongwith others co-accused persons have criminally intimidated the 2 complainant and her family members by threatening to kill them with a knife and hurled abuses, thereby causing annoyance, alarm and distress to the victim and other persons. Based upon report of complainant, FIR was registered against the accused persons including the present applicants. Hence this bail application. 3. Learned counsel for the applicant submits that applicant has been falsely implicated in this case, he has not committed any offence as alleged against him. There is some money related dispute between co-accused -Ram Narayan and his wife (complainant) who has used her minor daughter to implicate the accused persons in false case. As per best of knowledge of applicants, the complainant had also earlier tried to implicate her earlier husband using her other daughter. Charges have only been framed against the present applicants under Section 351(3), 115(2) and 296 of BNS, which are bailable in nature. Applicants are not having any previous criminal antecedent, they are in jail since 17.10.2025, conclusion of trial may take some time, hence, applicant may be released on bail. 4. Per contra, learned State Counsel opposing the bail application of the applicant. 5. Heard learned counsel for the parties. 6. Pursuant to order of this Court, complainant is appeared before this Court and she raised no objection in granting bail to the applicants. 7. Considering facts of the case, nature of allegations, submissions of learned counsel for the parties, particularly the fact there is no direct allegation against present applicants of committing any offence 3 upon minor daughter of complainant, applicants are stated to have merely accompanied co-accused at the time of alleged incident, further considering that complainant is appeared before this Court and she raised no objection in granting bail to the applicants, detention period of the applicants and fact that conclusion of trial may take some time, without commenting anything on merits of the case, I am inclined to allow this bail application. 8. Accordingly, bail application is allowed. It is directed that applicants shall be released on regular bail, on their furnishing a bail bond in sum of Rs.10,000/- each with one surety in like sum to satisfaction of concerned Court on the conditions that- a) Applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court. b) Applicants shall not act in any manner which will be prejudicial to fair and expeditious trial, and c) Applicants shall appear before trial Court on each and every date given to them by the said Court till disposal of the trial. (d). On first Sunday of every month, the applicants shall appear before the concerned Police Station for marking their presence.
