THE REGIONAL MANAGER/AUTHORIZED OFFICER, ICICI LOMBARD GENERAL INSURANCE COMPANY LIMITED, ICICI BANK TOWERS, REGIONAL OFFICE, PLOT NO. 12, NANAKRAMGUDA, FINANCIAL DISTRICT, GACHIBOWLI,HYDERABAD, TELANGANA STATE - 500032. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue an order, direction or any appropriate writ, more particularly one in the nature of a WRIT CF MANDAMUS, declaring that the inaction of Respondent Nos.1 and 2, namely the Insurance Regulatory and Development Authority of India (IRDAI) and its Chairman, in failing to consider and decide the Petitioners statutory complaint dated 20.11.2025, is illegal, arbitrary, violative of the Insurance Regulatory and Development Authority Act, 1999, the IRDAI (Protection of Policyholders Interests) Regulations, 2017, and the IRDAI (Health Insurance) Regulations, and infringes Article 14 of the Constitution of India, and consequently direct Respondent Nos.1 and 2 to discharge their statutory duties in accordance with law and further declare the cancellation letter dated 22.10.2025 issued by Respondents No.3 and 4 in respect of Group Health Policy No. 4016/X/0/387869086/00/000 unilaterally as illegal, arbitrary, without jurisdiction and violative of the said Regulations, and consequently quash and set aside the same, in the interest of justice, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to stay the operation and effect of the cancellation letter dated 22.10.2025 issued by respondent 3 &4 relating to Group Health Policy No. 4016/X/C/387869086/00/000, and pass IA NO: 2 OF 2026 3 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to direct Respondents No.3& 4 to reinstate and continue Group Health Policy No. 4016/X/0/387869086/00/000 with all attendant benefits, including continuity advantages, waiver of pre-existing disease conditions, and cashless medical facilities, and to refrain from taking any coercive, adverse, or prejudicial action against the Petitioner Association or its insured members, and pass IA NO: 3 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased May be pleased to permit petitioner to amend the main prayer In the circumstancesstated above, it is therefore prayed that this Hon'ble Court may be pleased to issue an order, direction or any appropriate writ, more particularly one in the nature of a WRIT OF MANDAMUS, declaring that the inaction of Respondent Nos. 2 and 3, is illegal, arbitrary, violative of the Insurance Regulatory and Development Authority Act, 1999, the IRDAI (Protection of Policyholders' Interests) Regulations, 2017, and the IRDAI (Health Insurance) Regulations, and infringes Article 14 of the Constitution of India, and consequently direct Respondent Nos.2 and 3 to discharge their statutory duties in accordance with law within 3 weeks; and further declare the cancellation notice dated 22.10.2025 issued by Respondents No.4 & 6 in respect of Group Health Policy No. 4016/X/O/387869086/00/000 unilaterally as illegal, arbitrary, without jurisdiction and violative of the said Regulations, and consequently quash and set aside the same, in the interest of justice, and pass Counsel for the Petitioner: 1. Learned Standing Counsel for the respondent No.2 has placed a copy of the order, dated 21.04.2026 and would submit that the representation by the petitioner dated 20.11.2025, has been considered and passed orders and communicated to the petitioner. 3. Learned counsel for the petitioner also accepted the same. 4. In view of the fact that the relief sought by the petitioner is already addressed by the respondent No.2 by order dated 21.04.2026, in our considered view, no further adjudication is required in the present writ petition. 5. Accordingly, the Writ Petition is closed. 6. Liberty is granted to the petitioner to approach the appropriate forum, if so advised, if he has any further grievance. 7. There shall be no order as to costs.
