The petitioner is aggrieved by the order dated 31.07.2026 passed by the competent authority under Section 3(3) of U.P. Control of Goondas Act. Shri Surendra Kumar Mishra, learned counsel for the petitioner submits that the petitioner carried the impugned order dated 31.07.2026 in appeal registered as Appeal No. C202614000002625 of 2026 before the appellate authority i.e. respondent No.2/Commissioner of Police, Varanasi. The memo of appeal was accompanied by a stay application. The appellate authority neither decided the stay application nor the appeal on its merits. Further delay in deciding the stay application could render the cause of appeal infructuous. Learned AGA could not dispute the aforesaid fact. Interest of justice will be served by issuing the following directions :- I. The appellate authority i.e. respondent No.2/Commissioner of Police, Varanasi is directed to decide the stay application accompanied with the appeal registered as Appeal No. C202614000002625 of 2026 within a period of one month from the date of receipt of a certified copy of this order after giving Versus Counsel for Petitioner(s) : Surendra Kumar Mishra Counsel for Respondent(s) : G.A. Ashish Chauhan @ Bajarangi .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) opportunity of hearing to the petitioner. II. The appellate authority i.e. respondent No.2/Commissioner of Police, Varanasi is directed to decide the appeal within a further period of three months from the date of receipt of a certified copy of this order. Till the decision of the appeal, the effect and operation of the impugned order dated 31.07.2026 in case No. 335 of 2026 passed by the District Magistrate, Ghazipur under Section 3(3) of U.P.
