This application is directed against the order dated 29.10.2025, passed by the learned Additional Sessions Judge-I, Godda in Criminal Appeal No. 28 of 2025, whereby and whereunder, the order dated 08.09.2025, passed by the learned Principal Magistrate, Juvenile Justice Board, Godda in connection with Basantrai P.S. Case No. 57 of 2025 rejecting the prayer for bail of the petitioner has been affirmed. Submission has been advanced by the learned counsel for the petitioner that in similar circumstances one of the co-accused namely Sunni Tatwa has been granted bail in Cr. Revision No.229 of 2026. It has been submitted that the petitioner is in custody since 28.07.2025. Learned A.P.P. has opposed the prayer for bail of the petitioner. Regard being had to the aforesaid fact, this Court while setting aside the order dated 29.10.2025, passed by the learned Additional Sessions Judge-I, Godda in Criminal Appeal No. 28 of 2025 as well as the order dated 08.09.2025, passed by the learned Principal Magistrate, Juvenile Justice Board, Godda in connection with Basantrai P.S. Case No. 57 of 2025, direct the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate, Juvenile Justice Board, Godda in connection with Basantrai P.S. Case No. 57 of 2025, subject to the conditions that the father of the petitioner shall ensure the safety of the petitioner and shall further ensure the petitioner is kept away from anti-social elements.
