This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.294/2025 registered at Police Station – Chhuriya, District – Rajnandgaon (C.G.) for the offence punishable under Sections 316(5), 318(4), 336(2), 336(3), 338, 340(2), 61(2) of BNS. Prosecution case in brief is that the complainant has lodged the report to the concerned police station stating that under the Pradhan Mantri Fasal Beema Yojana, Year 2024-2025, in the village of Amgaon in the Chhuriya Block, over 50 hectares of land was registered in 34 Khasra in the name of Mr. Jai Bagga, Mr. Vaibhav Golchha, and Mr. Sudarshan Verma, partners of Rallij Bio Energy Private Limited. A banana crop had been cultivated on this land for over a year. Despite this, in the year 2024-2025, Fasal Beema Yojana was obtained on the said land by showing a chickpea crop. Without any harvesting or preparation of a panchnama, and in collusion with Agriculture Department officials, the Patwari, and the insurance agent, claims were processed and insurance payouts exceeding ₹25 lakh were wrongfully disbursed by showing loss of a non-existent chickpea crop.

Learned counsel for the applicant submits that the applicant is innocent person and she has not committed any offence as alleged against her and she is falsely implicated in the present case. It is further submitted that the applicant was unaware of the amount deposited in her account and after knowing the deposit, she informed the police station and the Senior Agriculture Development Officer, Chhuriya, that an insurance amount of ₹12,48,726.33 has been deposited into her account without her knowledge in the State Bank of India, which has no connection to her. Further submission is that the applicant has not taken out any fraudulent crop insurance and has not intentionally committed any crime, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail to the applicant. 3
5. I have heard learned counsel for the parties and perused all of the documents taken on record. 6. Considering the facts and circumstances of the case, and further taking into consideration that she neither received the fund in question nor derived any benefit from it and has been accused entirely based on unfounded suspicion, I am inclined to extend the benefit of Section 482 of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.S.) to the applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Gangeshwari Sahu, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade her from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of her adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e)The Applicant shall not involve herself in any offence of similar nature in future.
