For the respondents : None Rakesh Kainthla, Judge (Oral) The present petition has been filed against the order dated 02.02.2026 vide which the learned Trial Court had declined to send the DVD to the FSL for forensic examination. A perusal of the impugned order passed by the learned Trial Court shows that the application seeking forensic examination of the DVD was declined on the ground that the witnesses proposed to be examined in support of the allegations contained in the supplementary charge sheet were yet to be examined. 2 not declined to send the DVD for forensic examination but had declined to do so at this stage, pending the examination of the witnesses. The approach of learned Trial Court cannot be faulted, unless some witnesses appear before the Court to vouch safe the correctness of the CD, it is futile exercise to send the DVD to FSL for forensic examination. Hence, no interference is required with the order passed by learned Trial Court at this stage. However, it is expressly made clear that the order passed by learned Trial Court or this Court will not prevent the State from filing the application for sending the DVD for forensic examination at an appropriate stage after the examination of the witnesses and such an application shall be considered and decided by the learned Trial Court, without being influenced by any observation made in the order dated 02.02.2026 passed by learned Trial Court or by this Court.
2. In view of the above, the present petition is disposed of, so also the pending miscellaneous application(s), if any. (Rakesh Kainthla) Judge 23rd June, 2026 (Nikita)
