Petitioner, claiming to have been allotted room Nos. 302 and 303 at Hotel Heaven, Dalagate, Srinagar, owing to serious security threat and perception being in possession of the said protected accommodation since 2005 pursuant to the directions of this Court, is now aggrieved of the Notice bearing No. Sec-K/Dy.SP/Notice/26/85-87, dated 11th of February, 2026, whereby he has been directed to vacate room No. 303, within a week, from the date of issuance of the said notice, on the ground that the allotment of the room had been cancelled on 26th of April, 2018, vide Order No. Sec/J&K/Estate/P-07/2017-18/2529-38 issued by the Senior Superintendent of Police, Security, J&K. 2. Learned counsel for the petitioner, submits that the petitioner is a protected person and is entitled to security accommodation, and that the impugned notice has been issued without affording him an opportunity of being heard. He further submits that the petitioner would be satisfied, if the present petition is disposed of at this stage with a direction to the respondents to hear the plea raised by him with regard to the matter within a specific timeframe, while protecting his possession till such decision is made. 3. In view of the facts and circumstances of the case, submissions urged at the Bar and the innocuous prayer raised by the learned counsel for the petitioner, the petition is disposed of at this motion stage with a direction to the respondents to consider the representation, if any, to be filed by the petitioner within one week and decide the same by passing a reasoned and speaking order, within a period of two weeks, thereafter. Till such time, respondents are restrained from evicting the petitioner from room 303 pursuant to Notice No. Sec-K/Dy.SP/Notice/26/85-87, dated 11th of February, 2026. 4.
