JUSTICE M.I.ARUN ORAL ORDER 1. The case of the petitioner is that respondent No.6 is putting up construction on the marginal land adjoining the National Highway in violation of law. Hence, he has given representation to respondent Nos.1 to 3. As no action has been taken, the present writ petition is filed with the following prayers:- "a) Issue writ of mandamus, and to direct the Respondent No.1 to 3 as per the Annexure-A, to Annexure-A2, Representations dated 08.10.2025, respectively and consider Memorandum filed by the Petitioner pending before the Respondents, within 30 days expeditiously as possible. b) Issue writ or order or direction in the form of writ as the Hon'ble Court deems fit under the circumstances of the case." 2. Learned AGA appearing for respondent Nos.1, 2, 4 and 5 submits that the appropriate authority to look into the complaint of the petitioner is respondent no.5. It is submitted that if the petitioner were to make a proper representation to respondent No.5, after hearing all the parties concerned, - 4 - HC-KAR NC: 2026:KHC:14112 WP No. 4282 of 2026 respondent no.5 would consider the same in accordance with law and pass appropriate orders thereafter. 3. Petitioner and respondent no.6 are agreeable for the same. 4. Hence the following:- ORDER i. The writ petition is disposed of. ii. Petitioner and respondent No.6 shall appear before respondent no.5 on 06.04.2026 without further notice. iii. Petitioner and respondent No. 6 are given liberty to make their submissions before respondent No.5. After considering the representation of the petitioner and respondent no.6 and such other person which respondent no.5 deems appropriate to hear, he shall pass appropriate orders in accordance with law thereafter.
