Gupta, appeared before the Court of Additional Civil Judge (Junior Division), Court No. 3, Kanpur Nagar, on 22.09.2026, where they stated that they had entered into the compromise voluntarily and that they did not wish to pursue the matter any further. 4. Learned counsel for the accused-applicant submits that, in view of the compromise arrived at between the husband and wife, no useful purpose would be served in permitting the aforesaid criminal proceedings to continue and, therefore, the same may be quashed. 5. It is apparent from the record that the marriage between Sunil Gupta and Smt. Sonali Gupta was solemnized on 20.11.2003. Soon thereafter, matrimonial discord arose between the parties. The wife alleged that she was subjected to harassment and cruelty on account of non-fulfilment of an alleged demand for dowry.
Ultimately, she instituted the aforesaid complaint, in which, by order dated 05.04.2013 passed by the Additional Chief Judicial Magistrate, Court No. 7, Kanpur Nagar, the husband, Sunil Gupta, and his relatives, namely, Smt. Vijay Laxmi Gupta, mother-in-law; Gopal Gupta, elder brother-in-law; Smt. Shalini Gupta, wife of the elder brother-in-law; Smt. Savitri Gupta, sister-in-law; and Ajit Gupta, husband of the sister-in-law, were summoned to face trial for the offences under Sections 498-A, 323, 504 and 506 IPC and Sections 3/4 of the Dowry Prohibition Act. 6. Aggrieved by the aforesaid summoning order and the consequential proceedings, the accused-applicant approached this Court by filing Application under Section 482 No. 40473 of 2017 and Application under Section 528 B.N.S.S. No. 38219 of 2026. 7. Since the parties have amicably settled their matrimonial dispute and have voluntarily entered into a compromise, which has also been duly verified by the court concerned, and both the husband and wife have categorically stated that they do not wish to pursue the matter any further, this Court is of the view that no useful purpose would be served by permitting the criminal proceedings to continue. 8. Accordingly, both the aforesaid applications are allowed. NA528 No. 38219 of 2026 2
