The petitioner is apprehending his arrest in connection with Gomia P.S. Case No. 03 of 2026, registered for the offence under Sections 317(5) and 3(5) of Bhartiya Nyaya Sanhita, 2023 and Section 30(ii) of the Coal Mines Act, 1973, pending in the court of learned Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioner submits that the petitioner happens to be owner of the truck and the allegations are made of carrying thirty tons coal on the said truck. He further submits that the said vehicle was being driven by the driver and the coal was booked by another person. On these grounds, he submits that the anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of carrying coal in absence of any valid challan. 5. Considering that the petitioner is the owner and it has been pointed out that the said coal was booked by another person, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Bermo at Tenughat, in connection with Gomia P.S.
