3. After some hearing, Mr. Lewish Edward, learned counsel for the applicant, seeks permission to withdraw the present bail application. He, however, requests that appropriate directions be issued for the expeditious recording of the evidence of the material witnesses. He submits that the eye-witness has been partly examined-in-chief but is appearing only intermittently on the dates fixed for hearing. 4. Having regard to the length of custody of the petitioner, the Trial Court is requested to take all practicable steps in this regard, subject to its own Board and the age of matters pending before it. Mr. Srivastava submits that the prosecution shall also extend its cooperation to ensure the expeditious progress of the trial. 5. The bail application, alongwith the pending application, is dismissed as withdrawn, in terms of the above submission. 6.
It is made clear that, in the event the recording of the evidence of the material witnesses is inordinately delayed, the applicant shall be at liberty to move a fresh application before the learned Trial Court, in accordance with law. 7. It is clarified that this Court has not expressed any opinion on the merits of the case or on any application that may be filed by the applicant hereafter, which shall be considered by the appropriate Court on its own merits, in accordance with law.
