HIGH COURT OF JUDICATURE AT ALLAHABAD CRIMINAL MISC. WRIT PETITION No. - 24453 of 2026 Court No. - 45 HON'BLE SALIL KUMAR RAI, J.
HON'BLE PADAM NARAIN MISHRA, J.
1. Heard learned counsel for the petitioners and learned AGA for the State-respondent nos. 1 & 2.
2. The present writ petition has been filed challenging the FIR dated 29.08.2026 registering Case Crime No.202 of 2026, under Sections 318(4), 338, 336(3), 340(2) and 61(2) of B.N.S., Police Station Mant, District Mathura.
3. It has been argued by the learned counsel for the petitioners that dispute between the parties relates to the right of the first informant to get the sale deed executed. It has further been argued that the first informant has right to approach the Civil Court for redressal of his grievance and the criminal proceedings are not maintainable. It has also been argued that even from the recitals in the F.I.R., no offence has been committed by the petitioners.
4. Learned AGA has opposed the present petition.
5. In view of the order proposed to be passed, it would serve no useful purpose by issuing notice to respondent no.3 and calling for a counter affidavit.
6. Accordingly, without entering into the merits of the case and after considering the arguments of the counsel for the petitioners, the writ petition is disposed of with a direction that the petitioners shall not be Versus Counsel for Petitioner(s) : Mayank Srivastava, Sakshi Srivastava, Shikhar Neelkanth Counsel for Respondent(s) : G.A.
