1. Heard Mr.Amit Kumar, learned counsel for the petitioner as well as Mr.Saumya Rai, learned Panel Lawyer appearing for the respondent/State. 2. The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :-

2 kindly be pleased to exercise its inherent jurisdiction under Section 528 of B.N.S.S., 2023 and in exercise thereof call for the records, if necessary, admit the petition and may kindly be pleased to allow this petition and to quashing of the FIR no. 148/2025 as well as charge sheet filed before the learned trial court which is 16621/2025 registered as criminal case no. on 03.05.2025 and cognizance order dated 03.05.2025 for offence punishable under Section 318(4), 61(2), 111(3) of B.N.S. by the Police Station Supela, District Durg (C.G.), Cognizance Order (First Order Sheet) dated 03.05.2025 in Criminal Case No. 16621/2025 and after the learned court below committed the case to session court learned session court registered the case as Session trial no. 114/2025 which is pending before the 1st Additional Session judge Durg Dist. Durg (C.G) and (if any), all consequent proceedings incidental & accidental thereto and orders prejudicial to the petitioner herein and/or pass such other orders in favour of the petitioner as this Hon'ble Court may deem it fit in the facts and circumstances of the case.”

From perusal of the prayers made in the instant petition, it transpires that the petitioner has prayed for the quashing of FIR No. 148/2025 as well as the chargesheet filed before the learned trial court, registered as Criminal Case No. 16621/2025 on 03.05.2025, and the cognizance order dated 03.05.2025 for offences punishable under Sections 318(4), 61(2), and 111(3) of B.N.S., by Police Station Supela, District Durg (C.G.).
They have
3 also prayed for quashing of the cognizance order (First Order Sheet) dated 03.05.2025 in Criminal Case No. 16621/2025 and, after the learned court below committed the case to the Sessions Court, the subsequent registration of the case as Session Trial No. 114/2025, which is pending before the 1st Additional Sessions Judge, Durg, District Durg (C.G.), along with any and all consequent proceedings, incidental and ancillary thereto. This demonstrates that the prayer drafted by the learned counsel for the petitioner has been made in a very casual manner and has further wasted the precious time of the Court. Accordingly, in the opinion of this Court, the prayer is defective. 4. Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition with appropriate prayer, subject to depositing a sum of Rs.5,000/- as cost by the petitioner in the Registry of this Court and the same shall be transmitted to the Government Special School for Intellectually Retarded Girls, Gangapur, Ambkapur, District Surguja (CG). 5. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioners after retaining the photocopies of the same.
