JUSTICE JAYANT BANERJI) The instant appeal No.3550/2024 is filed seeking to set aside a common judgment and decree dated 28.03.2024 passed by V- Additional Principal Judge, Family Court in Bengaluru, in MC No. 6024/2018 and to dismiss the petition filed under Section 9 of the H.M. Act. 2. By means of the impugned common judgment and decree, the petition filed by the petitioner/husband in

HC-KAR NC: 2026:KHC:23935-DB MFA No. 3550 of 2024 C/W MFA No. 3547 of 2024 MC No. 6626/2021 under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 was dismissed and the petition filed by the wife in MC No. 6024/2018, under Section 9 of the Hindu Marriage Act, seeking decree of restitution of conjugal rights was allowed. Further, the petition filed by the wife in Criminal Misc.No.809/2018 under Section 125 of the Cr.P.C, seeking maintenance was allowed in part. 3. The connected MFA No.3547/2024 is filed by the husband against the aforementioned judgment and decree dated 28.03.2024 in MC No. 6626/2021 seeking grant of decree of divorce. 4. A joint memo has been filed by the appellant and respondent today in Court. It is signed by the parties as well as their respective advocates. This joint memo is supported by separate verifying affidavits of both the appellant and the respondent, and encloses documents as Annexures-A and B. The joint memo reads as below:-
“JOINT MEMO The Appellant and the Respondent respectfully submit as follows:

1. The Appellant and the Respondent submit that they have amicably resolved all their disputes in the mediation proceedings arising out of Crl. Misc. No. 531/2024 on the file of the Hon'ble V Addl. Prl. Judge, Family Court at Bengaluru, which was filed for recovery of arrears of maintenance. 2. It is submitted that the parties have entered into a Memorandum of Settlement dated 02.06.2025 before the Mediation Centre and thereafter a Joint Memo dated 02.04.2026. The same have been accepted by the Hon'ble Court and an order has been passed on 04.04.2026 in terms thereof. The respondent herein has agreed to consent for decree of divorce in the above appeal. The Order dated 04.04.2026 in Crl. Misc.
No.531/2024 along with the Memorandum of Settlement dated 02.06.2025 and the Joint Memo dated 02.04.2026 are produced herewith as Annexure-A and Annexure-B respectively. 3. The Appellant submits that, in terms of the settlement, a total sum of Rs.45,00,000/- (Rupees Forty-Five Lakhs only) has been agreed to be paid to the Respondent, out of which a sum of Rs.30,00,000/-(Rupees Thirty Lakhs only) has already been paid. 4. The balance amount of Rs.15,00,000/- remains payable. Out of the said balance:

HC-KAR NC: 2026:KHC:23935-DB MFA No. 3550 of 2024 C/W MFA No. 3547 of 2024 • A sum of Rs.10,00,000/- (Rupees Ten Lakhs only) is being paid by way of cheque bearing No. 003615 drawn on ICIC/ Bank, Uppal Kalan Branch, Hyderabad dated: 27:04.2026. • The remaining sum of Rs.5,00,000/- (Rupees Five Lakhs only) by way of cheque bearing no 003613 dated 28.04.2026, drawn on ICICI bank, Uppal Kalan Branch Hyderabad. 5. Respondent shall co-operate for closure/Quashing of C.C. No.14016/2019 on the file of the Hon'ble 7th Addl. Chief Judicial Magistrate, Bengaluru. 6. In view of the above settlement, the parties submit that all disputes between them have been fully and finally resolved and neither party has any further claims against the other. 7. In light of the Memorandum of Settlement and the Joint Memo, it is most respectfully prayed that this Hon'ble Court may be pleased to: • Allow the appeals in MFA No. 3550/2024 and MFA No.3547/2024; and • Grant a decree of divorce as prayed for therein. 8. This Joint Memo is filed in the interest of justice and equity.”

5. It is evident from perusal of the aforesaid joint memo and the contentions of the learned Advocates that the parties have voluntarily and freely settled their differences of their own free will and accord without any pressure, undue influence, coercion or fraud.
The entire amount of Rs.45,00,000/- mentioned in the joint memo stands paid pursuant to the balance amount of Rs.15,00,000/- (Rupees Fifteen Lakhs only) being paid today in Court by means of two cheques. It is stated that in terms of the settlement mentioned in the joint memo, all the cases and disputes pending between the parties have been finally settled. It is stated by the parties that none of the parties has any further claim against each other. 6. The aforesaid joint memo is accepted. 7. The aforesaid appeals are allowed. 8. The impugned order in MFA No.3550/2024 dated 28.03.2024 passed in MC No.6024/2018 is set aside and the petition filed by the wife under Section 9 of the H.M. Act is dismissed. - 8 -

9. Further the impugned judgment and decree challenged in MFA No.3547/2024 dated 28.03.2024 in MC No.6626/2021 is set aside and a decree of divorce as prayed is granted. The marriage between the parties solemnized on 15.08.2014 at Sri. Venkateshwara Kalyana Mantapa, Saraswathapur, Dharwad, Karnataka State, is dissolved. 10.
