CMP (M) No. 574/2026 The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that certified copy of the judgment and decree, dated 27.09.2025, as passed by the learned first appellate Court, was applied on 18.10.2025 and delivered on 27.10.2025. After receipt of the aforesaid certified copy, entire case file was sent to the zonal office after obtaining opinion from the counsel. The zonal office gave approval to file an appeal before this court and thereafter the case was handed over to the counsel to file an appeal before this court. However, on account of ill-health and thereafter demise of the mother of the counsel, the appeal was not filed within the stipulated time. The counsel, after completing last rites of his mother, prepared the instant appeal and filed in the Court without any further delay. It has been further averred that the aforesaid delay is neither intentional nor deliberate, but has occurred due to unavoidable circumstances, which were beyond the control of the applicant. Learned counsel for the non- applicant/respondent No.2 has not opposed the instant application. In view of the averments as made in the application, which is duly supported by an affidavit, more particularly, paras 2 and 3 thereof coupled with submissions made by learned counsel for the applicant, the present application is allowed and the delay in filing the appeal is condoned. Application stands disposed of. RSA No. 2026 Appeal be registered. Learned counsel for the appellant is directed to supply a copy of entire paper book to the learned counsel for the respondent(s) during the course of the day. List for admission after two weeks.
