2. The petitioners are apprehending their arrest in connection with Dhansar P.S. Case No.06 of 2026, for the alleged offences registered under Sections 126(2), 127(2), 190, 191(2), 191(3), 115(2), 117(2), 109(1), 324(5), 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case alleging that the petitioners were trying to demolish the boundary wall erected on the land and pursuant to that the altercation took place. He further submits that there are general and omnibus allegation against all the accused persons. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that allegations of assault are there and pursuant to that four persons have also received the injury.

Looking into the contents of the FIR it transpires that there is direct allegation of assault against petitioner No.1 and in view of that I am not inclined to provide anticipatory bail to the petitioner No.1 namely Govind Mahato @ Govind Mahto. Hence, the prayer for anticipatory bail of the petitioner No.1 namely Govind Mahato @ Govind Mahto is hereby rejected.

So far petitioner Nos.2 to 5 are concerned, there are general and omnibus allegation against them of assault and they are having no criminal antecedent as disclosed in paragraph No.20 of the petition and in view of that I am inclined to provide anticipatory bail to the petitioner Nos.2 to 5 namely Ramu Rajak, Bablu Gorain @ Bablu Gorai, Manoj Rajak and Munna Rajak respectively.
7. Accordingly, the petitioner Nos.2 to 5, above named, are

hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioner Nos.2 to 5, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Dhanbad in connection with Dhansar P.S. Case No.06 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
