The present application has been filed by the petitioner under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the ‘BNSS’) seeking grant of regular bail in FIR No.153/2026 registered at Police Station Govindpuri, New Delhi, initially for the offence punishable under Section 137(2) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as the ‘BNS’). Subsequently, the chargesheet has been filed under Sections 137(2) and 87 of the BNS. 3. Learned counsel for the petitioner submits that it is a case of elopement and that the victim has not stated anything adverse against the petitioner in her statement recorded under Section 183 of the BNSS before the learned JMFC. 4. He further submits that although the prosecutrix, in her statement recorded under Section 180 of the BNSS levelled allegations against the petitioner, in her subsequent statement recorded under Section 183 of the BNSS she did not make any allegation against him. 5. Considering that the present case appears to be one of elopement and keeping in view the facts and circumstances of the case, the petitioner is directed to be released on regular bail on furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount, to the satisfaction of the learned Trial Court, subject to the following conditions: i. The petitioner shall not leave India without prior permission of the learned Trial Court. ii. The petitioner shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address. iii. The petitioner shall appear before the learned Trial Court as and when the matter is taken up for hearing. iv. The petitioner is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v. The petitioner shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner. vi. The petitioner shall report at the office of concerned SHO, PS Govindpuri, New Delhi. first Monday of every month at 11:00 a.m. and he shall be discharged by 12 noon, after recording his presence and completion of all the necessary formalities; This is a digitally signed order.
