PETITIONER ON BAIL IN CR.NO.130/2025 PENDING ON THE FILE OF HONBLE II JMFC AT MYSURU FOR ALLEGED THE O/P/U/S 109 OF BNS ACT AND U/S 27,30 OF INDIAN ARMS ACT.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE E.S.INDIRESH
ORAL ORDER
This petition is filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking to enlarge the petitioner on bail in Crime No. 130/2025 on the file of the II JMFC at Mysore for the offences punishable under Section 109 of Bharatiya Nyaya Sanhita,2023 and under Section 27 and 30 of The Arms Act,1959.
2. Since the learned counsel on record was regularly absent, this court has appointed Sri Deepak Wagle as amicus curiae to assist in the proceedings.
3. Learned Amicus curiae, submitted that the petitioner herein is not involved in the alleged offence in Crime No.130/2025. Further, learned Amicus Curiae

argued that there is a delay in lodging the complaint and therefore, sought for enlarging the petitioner on bail. It is also contended by the learned Amicus curiae, that the petitioner is aged about 53 years and is having a family at Kodagu District and as the petitioner is not involved in the commission of alleged offences, hence, learned Amicus Cusiae sought for enlarging the petitioner on bail.
4. Per contra, learned High Court Government Pleader appearing for the respondent-State, submitted that after the incident has taken place, the live cartridges were seized from the possession of the accused/petitioner. Learned HCGP also refers to the statement of the eyewitnesses, and accordingly, sought for dismissal of the petition.
5. In light of the submissions made by the learned Amicus curiae for the petitioner and learned HCGP for the respondent-State, taking into consideration the averments made in the complaint, it is not in dispute that the

investigation officer has recovered the live cartridges from the possession of the accused/petitioner. Therefore, I am of the view that, at this stage, in the event, if the petitioner is released on bail, there is every likelihood of petitioner tampering the witnesses. In that view of the matter, the petition stands dismissed.
6. This Court places on record the assistance rendered by Sri Deepak Wagle, as an amicus curiae in the matter. Accordingly, the Legal Services Authority is
directed to pay the legal fee of Rs.10,000/- to the amicus curiae for assisting the Court.
7. Copy of the same is to be made available to the Karnataka Legal Services Authority for payment of the legal fee to Sri Deepak Wagle, as an amicus curiae
