JUSTICE E.S.INDIRESH ORAL ORDER In this petition, the petitioner is seeking an appointment of Arbitrator to resolve the dispute between the parties in terms of Clause 17 of the Partnership Deed dated 02nd April, 2008 (Annexure-A). 2. Heard Smt. Sadiya Khanum, learned counsel appearing for the petitioner and Sri. Raghu H.V., learned counsel appearing for the respondent. 3. Sri. Raghu H.V., learned counsel appearing for the respondent opposed the petition by referring to the Deed of Dissolution of Partnership dated 19th September, 2023 as per Annexure-B to the statement of objections. 4. Having taken note of the submission made by learned counsel appearing for the parties, I am of the view that, appointment of Arbitrator is necessary for resolution of dispute between the parties as contained under the Partnership Deed dated 02nd April, 2008 (Annexure-A). - 3 - HC-KAR NC: 2026:KHC:16518 CMP NO.607 OF 2025 5. Therefore, Sri. M.K. Shripathi, District Judge (Retired) is appointed as an Arbitrator to resolve the dispute between the parties in the Arbitration and Conciliation Centre (Domestic and International), Bengaluru. 6. In order to avoid further delay in the matter, as the parties are represented by their respective counsels, parties are directed to appear before the Arbitration and Conciliation Centre (Domestic and International), Bengaluru on 22nd April, 2026 at 11.00 a.m. 7. All claims and contentions of the parties are kept open to be decided by the Arbitral Tribunal. 8.
