Sri Pawan Singh Pundir, learned counsel for the applicants and Sri Chavi Pal Singh, learned A.G.A. for the State are present. The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Special Case No. 1145/9 of 2021, arising out of Case Crime No. 67 of 2021, under Sections 363, 366 and 376 of I.P.C. and 3/4 of the POCSO Act 2012, Police Station- Budhana, District- Muzaffar Nagar, as well as cognizance/ summoning order dated 02.08.2021 pending in the Court of Additional Sessions Judge/ Special Judge (POCSO Act) Muzaffar Nagar. Learned A.G.A. pointed out that the aforesaid case is listed for argument and the applicant no. 1 is victim and applicant no. 2 is accused in the present case. The present application has been filed by the victim as well as accused. After some arguments, learned counsel for the applicant does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof. In view of the above, the application is dismissed as not pressed with the aforesaid liberty.
