For the reasons stated in the petition, issue notice. 3. Mr. Singh, learned counsel accepts notice on behalf of the respondents. 4. It is the case of the petitioner that the petitioner was born on 02.01.2001, which was duly recorded in the original/manual birth certificate bearing old registration No. 618 and is supported by documents like passport issued by the competent passport authority and the election photo identity card/voter I.D. However, his Class X and XII marksheet records his date of birth as 01.01.2000. 5. Additionally, the names of the parents of the petitioner namely “Vikas Dargan” (Father) and “Komal Dargan” (Mother) were also recorded wrongly as “Vikas Arora” and “Komal Arora” in the Class X and XII marks statement/certificate. 6. After identifying these discrepancies in the petitioner’s academic This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 23/07/2026 at 12:24:13 records, the petitioner traced the original/manual birth certificate in 2024 and consequently pursued verification and reconciliation of the municipal records and has obtained necessary government documents. 7. Thereafter, the petitioner approached the concerned authorities of respondents/CBSE in 2026 through a written application for the aforesaid reconciliation requesting correction of the records wherein the respondents declined to receive or acknowledge the written application or supporting documents and directed the petitioner to first approach the respective schools from which he had appeared in the Class X and Class XII examinations. 8. Pursuant to these directions, the petitioner approached his former secondary and senior school namely Mukand Lal Katyal Senior Secondary School, Ashok Nagar, New Delhi (for Class X) and MCL Saraswati Bal Mandir, Hari Nagar, New Delhi, (for Class XII) records, however these schools also denied to receive or acknowledge his grievance and was informed to approach respondents/CBSE directly. 9. In light of the above, the petitioner approached respondents/CBSE again by way of a written application dated 25.06.2026 in response to which, the respondents declined any acknowledgement and rejected the application without any reasons and reiterated that the petitioner should approach the relevant schools. 10. Aggrieved by the same, the petitioner has approached this Court by way of the present petition to seek correction of his educational records and to make them consistent with other government documents. 11. Learned counsel for the petitioner states that these inconsistencies in his educational records and government documents have been causing the This is a digitally signed order. The Order is downloaded from the DHC Server on 23/07/2026 at 12:24:13 petitioner recurring and continuing prejudices which may also have adverse consequences on his admission to LL.M. course. 12. It is also stated that there is no dispute concerning the identity or the relationship of the petitioner’s parents with the petitioner or the authenticity of the documents place on record clearly stating the date of birth of petitioner to be 02.01.2001 and his names of the parents being “Vikas Dargan” and “Komal Dargan” respectively. 13. Mr. Singh, the learned counsel for the respondents/CBSE objects to the present petition being allowed on the ground that it is filed belatedly i.e., after 5 years and there is no valid justification for the delay. 14. However, I am unable to agree with the respondent’s objection as the petitioner is entitled to get these corrections made in his educational documents in order to make it consistent with other documents duly issued by the government. 15. My attention has been drawn to Annexure P-2 of the petition which is a birth certificate dated 22.01.2001 issued by the Government of National Capital Territory of Delhi under Section 12 & 17 of the Registration of Births and Deaths Act, 1969, showing the date of birth of the petitioner as 02.01.2001 and the full names of his father and mother as “Vikas Dargan” and “Komal Dargan” respectively. 16. I have already in a similar matter of Nisha Ray v. Central Board Of Secondary Education & Anr. W.P.(C) 6554/2023, by relying on the judgment of Hon’ble Supreme Court in the case of Jigya Yadav v. CBSE (2021) 7 SCC 535, reiterated the holding of the Hon’ble Apex Court that there can only be one Date of Birth and reconciliation of such discrepancies to make it consistent with other documents will cause no This is a digitally signed order. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 23/07/2026 at 12:24:13 prejudice to respondents/CBSE. Hence, the same must be allowed. 17. In the present case, the discrepancy in date of birth and in the particulars of his parents (surnames of father and mother) is apparent from a bare perusal of the Birth Certificate bearing Old Registration No. 618 and is also supported by the Passport, Election Photo Identity Card/Voter ID, Aadhar Card, PAN Card and also by Aadhar Card and PAN Card of his father and mother. 18. I am of the view that if this petition is not allowed, the petitioner would be having two dates of births and inconsistent particulars of his parents, one shown in public documents like birth certificate, passport, election photo ID card, Aadhar card, PAN card and the other reflected in these given marksheets. 19. Accordingly, the records of the petitioner with the respondents/CBSE, and schools namely Mukundlal Katyal Senior Secondary School (for Class-X) and MLL Saraswati Bal Mandir (for Class-XII), shall be corrected to the extent of correction of date of birth from 01.01.2000 to 02.01.2001 and name of petitioner’s father and mother from “Vikas Arora” and “Komal Arora” to “Vikas Dargan” and “Komal Dargan” respectively. 20. For the said reasons, the present petition is allowed and disposed in the aforesaid terms. JASMEET SINGH, J JULY 17, 2026 / (MS) This is a digitally signed order.
