A preliminary objection has been raised by learned counsel for the respondent as to the maintainability of this petition on the ground that Gram Pradhan of the village has engaged private counselor, hence this petition in view of the judgment of this Court in the case of Babu Ram Verma v. Sub Divisional Officer and Others, 1996 LawSuit (All) 645, decided on on 19th January, 1996, private counselor cannot be engaged except with approval of the District Magistrate/Collector. Learned counsel for the petitioner submits that he may be permitted to withdraw this petition with liberty to approach this Court again in accordance with law. Learned counsel for the respondent does not have objection to the above request. Petition is accordingly dismissed with the aforesaid liberty.
