After hearing learned counsel for the parties at length and upon perusal of the record, it transpires that the prosecution evidence already stands concluded and the statement of the petitioner under Section 342 CrPC has also been recorded. The matter is now fixed for final arguments/conclusion before the trial Court. In such circumstances, this Court does not deem it appropriate to examine the present petition on merits at this stage, particularly when the trial has reached its fag end. Learned counsel for the petitioner, however, submitted that the petitioner has remained in custody for more than five years and that his right to speedy trial stands infringed. 2. Be that as it may, having regard to the stage at which the present bail application has been filed and the fact that the challan is now ripe for final adjudication, this Court is not inclined to interfere with the order passed by the trial Court at this juncture. Nevertheless, liberty is reserved in favour of the petitioner to approach the trial Court afresh by way of an appropriate application for bail in the event the trial is not concluded within a reasonable time. In such eventuality, the trial Court shall consider and decide the same expeditiously in accordance with law. 3. Furthermore, considering that the challan pertains to the year 2020, it is expected that the learned trial Court shall make earnest endeavours to conclude and dispose of the trial at the earliest possible. 4.
