2. Appellants/accused Nos.1 and 2 have preferred this appeal against the order passed by the I Additional District and Sessions Judge and Special Judge, Hassan in Crl.Misc.No.21/2026 dated 14.01.2026.
3. The brief facts leading to this appeal are that, on the basis of the complaint filed by Raghu H, Halebeedu Police have registered the case in Crime No.195/2025 against the accused Nos.1 to 4 for the offences punishable under Sections

HC-KAR NC: 2026:KHC:8401 CRL.A No. 208/2026 109, 115(2), 126(2), 352(3)(5) of the Bharatiya Nyaya Sanhita, 2023 (for short 'BNS, 2023') and Section 3(ii)(v)(a), 3(i)(r)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention Of Atrocities) Act,1989.
4. The appellants have filed application under Section 482 of BNSS, 2023 for grant of anticipatory bail. Same came to be rejected by the Trial Court. Being aggrieved by the rejection of the bail, the appellants have preferred this appeal.
5. I have heard the arguments of both sides and examined the material placed on record.
6. The learned Counsel for the appellants would submit that this Court has already granted bail to the accused Nos.3 and 4 in Crl.A.No.89/2026 dated 04.02.2026. The copy of the order is also produced before this Court. This Court has observed in its order that the accused-Gopi has assaulted complainant on his head with iron rod. Ravi has brought iron rods from his sooty and gave a blow to the complainant on his right and left arms. The memo produced with discharge summary of the injured, which reveals that the injured admitted to the hospital on 30.12.2025 and discharged on

01.01.2026. In this discharge summary, it is shown as assault by three known persons, but name of the accused is not shown. However, without expressing any opinion on the merits of the case, and also keeping in the mind of the order passed by this Court in Crl.A.No.89/2026 dated 04.02.2026, I proceed to pass the following:
ORDER Appeal is allowed.
i. The impugned order passed by the I Additional District and Sessions Judge and Special Judge, Hassan in Crl.Misc.No.21/2026 dated 14.01.2016 is set aside. ii. Consequently application filed under Section 482 of BNSS filed on behalf of appellants Nos. 1 and 2 who are accused Nos. 1 and 2, is allowed. iii. The appellants shall be released on bail in the event of their arrest in Crime No.195/2025 of Halebeedu Police on executing a self bond of Rs.50,000/- each with one surety each for the likesum, to the satisfaction of trial Court. iv. Appellants shall not tamper or threaten the prosecution witness in any manner.
