CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioner : Mr. Kumar Nishant, Advocate. For the State
: Mr. Satish Prasad, A.P.P. ------ 05/ 14.05.2026 Heard learned counsel for the petitioner and learned A.P.P for the State.
2.
The petitioner is apprehending his arrest in connection with Simdega (Mahila) P.S. Case No. 12 of 2026, registered for the offence under Sections 69 and 89 of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Chief Judicial Magistrate, Simdega.
3.
Learned counsel appearing for the petitioner submits that the petitioner and the informant were in relationship since October 2023 itself and even for two years, the informant has lived in the house of this petitioner in live-in relationship. He next submits that what has happened that was consensual in nature. On these grounds, he submits that anticipatory bail may kindly be provided to the petitioner.
4.
Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegations are there of establishing the physical relationship on the false pretext of marriage and the allegation of terminating the pregnancy of the informant is also there against the petitioner.
5.
Looking into the contents of the FIR, it transpires that

petitioner and the informant both were in relationship since October 2023 itself and they have met several times and further in the FIR, it has been stated that the informant has also lived in the house of the petitioner for about two years in live-in relationship, which prima facie suggests that the relationship was consensual in nature. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner.
6.
Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Simdega, in connection with Simdega (Mahila) P.S. Case No. 12 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
