This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for granting bail to the accused-applicant in connection with Bihpuria Police Station Case No. 117/2026 under Sections 179/180 of the Bharatiya Nyaya Sanhita, 2023. 3. An FIR was lodged on 03.07.2026, by one Satra Singh Pator, SI (UB), Bongalmara Outpost, before the Officer-In-Charge of Bihpuria Police Station, Lakhimpur, alleging, inter-alia that on 03.07.2026 at about 4:10 PM, Police received a reliable information that one pulsar 220 motorcycle bearing registration No. AS-07-V-8414, ridden by Ainul Hoque, who was coming from Pavha Chariali to Sonapur Centre under Bongalmara Outpost, carrying fake Indian currency notes. On receipt of such information, the police went to Sonapur Centre, wherein after seeing the police, the accused-applicant fled the spot, leaving the motorcycle there. After investigation and search of the motorcycle, the police found fake Indian currency notes amounting to Rs.3,00,000/- (Rupees Three Lacs). It is alleged that during investigation, it has come to the knowledge of the police that the accused-applicant has been carrying out the business of fake Indian currency notes, involving many people. 4. On receipt of the FIR, the Police registered Bihpuria Police Station Case No. 117/2026 under the aforementioned Sections. 5. It is seen that the accused-applicant was arrested on 08.07.2026 and since then he is behind the bars. 6. The learned counsel appearing for the accused-applicants submits that the Page No.# 3/3 accused-applicant is not involved in the instant case and he has been arrested only on the basis of suspicion and he has been behind the bars for last 42 (forty two) days. He submits that taking into account his long detention, he should be granted bail at this stage. 7 The Case Diary in the instant case has been produced and the same is perused. 8. Mr. B. Sarma, the learned Additional Public Prosecutor, on the other hand, opposes the prayer of bail to the accused-applicant, submitting that huge number of fake currencies is involved and investigation in the instant case is still going on. 9. Taking into account sufficient prima facie incriminating materials in the Case Diary as well as the submissions made by the learned counsel appearing for the respective parties, this Court is not inclined to grant any bail to the accused-applicant at this stage. 10.
