JUSTICE SAMEER JAIN Order 12/08/2026 1. The instant second bail application has been filed under Section 483 BNSS, 2023 on behalf of the accused-applicant. The accused-applicant was arrested in connection with FIR No. 432/2025 registered at Police Station Malakheda, District Alwar for the offence(s) under Sections 189(2), 115(2), 127(2), 109(1) of BNS, 2023. 2. Learned counsel for the accused-applicant submits that the accused-applicant is the head of his family, aged about 55 years, having no criminal antecedents registered against him. It is submitted that the applicant is behind bars since 25.11.2025 and that the charge sheet in the instant matter has already been filed. It is next submitted that the incident took place inter se the [2026:RJ-JP:31843] (2 of 2) [CRLMB-11596/2026] parties on account of some land dispute in fit of rage. It is submitted that the said act of violence has taken place in self defence. 3. Per contra, learned counsel for the respondent has strongly opposed the instant bail application and submitted that the victim was hospitalized for a period of approximately 14 days and that the injury inflicted to the victim is dangerous to life. 4. Having heard the arguments advanced by the learned counsel for the parties and taking note of the fact that there are no criminal antecedents registered against the applicant; that the applicant is sole bread earner of his family; that the accused- applicant is in custody since 25.11.2025, and looking to the overall facts and circumstances of the case and material on record but without commenting on merits/demerits of the case, this court is inclined to allow the bail application of the accused-applicant and enlarge him on bail. 5. Accordingly, this second bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Babulal Alias Babu Saini S/o Shri Ramnath shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so 6. Additionally, it is directed that the accused-applicant upon release on bail, shall not make any contact and/or cause threat to the complainant/victim, directly or indirectly.
