Baishya, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of BNSS, 2023 praying for the grant of pre-arrest bail to the petitioner, namely, Anupam Rajkonwar, in connection with Lakwa P.S. Case No. 13/2026 registered under Section 316(3)/112 of BNS, 2023. Page No.# 2/2
3. The petitioner was engaged as a handyman on the day on which the alleged offence took place. It appears from the FIR that a consignment of 60 nos. of drill pipes were to be delivered in the truck, in which, the petitioner was engaged as a handyman at the L.P. Yard, ONGC, Nazira, Sivasagar but only 28- 30 numbers were of drill pipes were found available at the site upon verification. 4. It is submitted that the petitioner was only engaged for one day as a handyman and the driver of the truck has already been arrested. Furthermore, the alleged offence, carries a punishment of up to 7 years imprisonment but no notice under Section 35 BNSS has been issued to the petitioner, which is against the mandate of the law laid down by the Hon’ble Apex Court in Satender Kumar Antil Vs. CBI and another 2026 Live Law (SC) 114. 5. Case Diary as called for has been received. Perused the case dairy. Petitioner has appeared before the I.O pursuant to interim protection granted earlier vide order dated 22.06.2026. Other than the statement of the co- accused, no other material is available in the case diary. 6. Having regard to the aforesaid facts and circumstances, the custodial interrogation of the petitioner is no longer necessary. Accordingly, the prayer for grant of pre-arrest bail is allowed. 7. The order of interim pre-arrest bail dated 22.06.2026 is hereby made absolute on the same terms and conditions as may be applicable as of date. 8.
The Anticipatory Bail petition, is accordingly stands disposed of. JUDGE Comparing Assistant
