Learned counsel for the petitioner submits that the petitioner is in custody in connection with Deoghar Town P.S. Case No. 249 of 2025 for the offence registered under Section 64(1), 376 of BNS, now said to have been pending in the court of learned Chief Judicial Magistrate, Deoghar. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the victim was around 17 to 18 years of age. He submits that the petitioner is in custody since 11.10.2025 having no criminal antecedent and the charge-sheet has already been submitted. 3. Learned counsel for the State has opposed the prayer and has submitted that as per the school records, the age of the victim was between 16 to 17 years and the petitioner has committed rape upon the victim at her residence. He submits that the statement of the victim has also been recorded under Section 183 of BNSS. 4. After hearing the learned counsel for the parties and from perusal of statement of the victim recorded under Section 183 of BNSS, this Court finds that there is direct allegation against the petitioner. Accordingly, this Court is not inclined to enlarge the petitioner on bail. Hence, this bail application is rejected. 5.
