1. Heard Mr. J. S. Ahmed, learned counsel for the accused applicant. Also heard Ms. S. H. Bora, learned Additional Public Prosecutor for the respondent State. 2. This application has been filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting anticipatory bail to the accused applicant in
Page No.# 2/3 connection with Dalgaon P.S. Case No. 116/2026 under Sections 351(2)/64(1)/78 of the BNS. 3. An FIR was lodged on 01.08.2026 before the Officer-in-charge of Dalgaon P.S. by the informant alleging inter alia that while she was waiting for a bus, the accused applicant came with a car and asked her whether she would like to be dropped in her place. When the informant went inside the vehicle and after proceeding for some time, the accused applicant showed the informant certain photographs and videos in his mobile phone wherein she could see that the accused applicant has stealthily taken some naked photographs and nude videos of the informant. 4. The accused applicant, thereafter, threatened her that if she does not consent for having some sexual intercourse with the accused applicant, then the photographs and videos will be made public. On such threatening, the informant consented to have sexual intercourse with the accused applicant and then they had a physical relationship in a hotel. 5. On the basis of this FIR, Police registered Dalgaon P.S. Case No. 116/2026 under the aforementioned sections. 6. Learned counsel appearing for the accused applicant submits that the accused applicant has been framed by the informant and also submits that the accused applicant had consensual sex and there is no possibility of physical relationship with the informant by force. He further submits that no photograph or videos have been made public by the accused applicant. He also submits that the accused applicant is willing to co-operate with the investigation and therefore custodial interrogation is not required. 7. On the other hand, Ms.

Page No.# 3/3 opposes the prayer for anticipatory bail of the accused applicant stating that there are sufficient incriminating materials in the Case Diary against the accused applicant. 8. Case Diary in this instant case has been produced and the same is perused. 9. In consideration of the submissions made by the learned counsel appearing for the respective parties and on perusal of the materials available in the Case Diary, at this stage, this Court is not inclined to grant any relief to the accused applicant. 10. Accordingly, this instant anticipatory bail application is disposed of as rejected. 11. Case Diary to be returned. JUDGE Comparing Assistant
