The instant appeal has been filed by the appellant being aggrieved by the judgment and order dated 19.02.2024 passed by the Additional Sessions Judge-I, Sant Kabir Nagar in Election Petition No. 5 of 2021 (Manoj Kumar Mishra and another vs. Arvind Kumar and others). In the said election petition, the challenge was to the post of Member, Kshetra Panchayat and the result of election was declared on 02.05.2021. 4. Vide order dated 03.01.2025, the appeal was admitted and the notices were issued to the respondents. The appellant was directed to take steps in the matter within two weeks. 5. As per office report, no steps have been taken. 6. Since tenure of the said election is already over after expiry of five years term, in such view of the matter, the instant appeal has become infructuous. 7. Accordingly, the instant appeal is dismissed as infructuous as well as for want of prosecution.
