Page No.# 2/3 BEFORE HONOURABLE MR. JUSTICE ANJAN MONI KALITA ORDER Date : 17.08.2026 Heard Mr. K. R. Bora, learned counsel for the accused applicants. Also heard Mr. B. Sharma, learned Additional Public Prosecutor for the State of Assam. 2. This is an application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for grant of pre-arrest bail to the accused applicants in connection with Pulibor P.S. Case No.57/2026, registered under Sections 74/109/309(6)/118(2)/249/3(5) of the BNS, 2023. 3. An FIR was lodged by one Smti Sivani Hazarika, alleging, inter alia, that a three-day programme comprising Bhauna (Drama) and Akhanda Bhagawat Path was organized for three days. On 20.06.2026 at about 12:00 PM, while the Bhauna programme was going on, Sri Jayanta Hazarika, along with his sons, Shri Akash Hazarika, Sri Ashish Hazarika and Sri Rinku Hazarika, allegedly created a disturbance at the venue by using filthy and abusive language and damaging chairs. It is further alleged that when the informant's husband, who was the President of the organizing committee, intervened to ascertain what had happened, the accused persons, namely, Sri Jayanta Hazarika, Shri Akash Hazarika, Sri Ashish Hazarika, and Sri Rinku Hazarika, allegedly assaulted him with a sharp iron rod with the intention of causing injuries. It is further alleged that, during the incident, although the informant's husband somehow managed to save his life, he sustained grievous injuries. 4. On receipt of the FIR, the police registered Pulibor P.S. Case No.57/2026 under the aforementioned sections. Page No.# 3/3
5. Mr. Bora, learned counsel for the accused applicants submits that two of the co-accused persons have already been granted bail. It is further submitted that the present accused-applicants are young persons, aged about 21 years, and taking into consideration their young age, they deserve to be granted pre- arrest bail. 6. Case Diary has been produced and the same is perused.
7. On the other hand, Mr. B. Sharma, learned Addl. P.P., opposes the prayer for pre-arrest bail by submitting that grievous injuries have been caused to the husband of the informant. Therefore, he prays that the instant anticipatory bail application be rejected. 8. Upon perusal of the Case Diary and taking into consideration the facts and circumstances of the case, this Court finds prima facie material against the accused-applicants. Accordingly, this Court is not inclined to grant pre-arrest bail to the accused-applicants at this stage. 9. Accordingly, the instant anticipatory bail application stands rejected. 10.
