1. Heard learned counsel for the applicant and learned counsel for the State. 2. The applicant, who is in custody since 20.09.2025, has approached this Court for grant of regular bail in connection with Complaint (Excise) Case No.1501 of 2019, for the offence under Sections 47(a)/ 55 of the Excise Act. Huge quantity of adulterated liquor has been recovered from the house of this applicant. 3. It has been submitted by the learned counsel for the applicant that complete set of Complaint Case/F.I.R along with its enclosures have been annexed with the present bail application and there is no suppression on his/ her part. Innocence of the applicant has been claimed and undertaking has been given for participation in the trial. It has been submitted that it is the first offence of this applicant and further, he is a simple labourer. The investigation is complete. On the above basis, prayer for bail has been made. 4. On the other hand, learned counsel for the State has opposed the prayer for bail. 5. Considering the nature of allegation and the period of custody, I am inclined to enlarge the applicant on bail.
Accordingly, the applicant is directed to be released on bail, on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bermo at Tenughat, in connection with Complaint (Excise) Case No.1501 of 2019 , on the condition that one of the bailors will be the father of this applicant and this - 1 - B.A. No.11445 of 2025
2026:JHHC:4933 applicant will report once in a month before the concerned police station, till the conclusion of trial and he will also submit self attested photocopy of his Aadhaar Card and his mobile number before the learned trial court which he will always keep active and will not change it during pendency of this case without prior permission of the court.
