Also heard Mr. P S Lahkar, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 528 of the BNSS, 2023 challenging the order dated 30.01.2026 passed by the learned Sub-Divisional Judicial Magistrate (S), Jorhat Page No.# 2/2 in respect of PRC Case No.699/2019. 3. For procuring the attendance of the petitioner Gajanand Munda, the trial court directed issue of Non-Bailable Warrant of Arrest against him. 4. Ms. Borah submits that the petitioner is interested in facing the trial and therefore, the petitioner should be given adequate opportunities to that effect. 5. I have considered the submissions made by the learned counsel of both sides. 6. This Court is of the opinion that since the petitioner is interested in facing the trial, he deserves to be given adequate opportunities to face the trial. 7. Therefore, all orders directing issue of Non-Bailable Warrant of Arrest against the petitioner are set aside. 8. The petitioner Gajanand Munda is directed to appear before the Court of the learned Sub-Divisional Judicial Magistrate (S), Jorhat in respect of PRC Case No.699/2019 within next 10 (ten) days from today. On his appearance, he shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (S), Jorhat.
