1. This Writ Petition has been filed against the inaction on the part of respondent authorities as while awarding compensation to the petitioner in lieu of land acquired bearing Khasra No.325/3, 326, 330, 336/1, 312/5 by them for the construction of Canal under the Scheme of Regabod-Kunda Project has been treated as non-irrigated land whereas the petitioner claims that the same is a irrigated land. 2. The petitioner has prayed for the following reliefs:-

2 respondent no.2 and 3 to assess the award amount of the petitioner on irrigated land and pay the balance compensation amount. 10.2. That this Hon'ble Court may kindly direct the respondents authorities to consider the representation of the petitioner. 10.3 Any other relief which this Hon'ble Court deems fit and proper may also be passed in favour of the petitioner together with cost of the petition. 3. Facts briefly stated of the case are that the petitioner is the owner of land having Khasra no. 325/3, 326, 330, 336/1, 312/5 situated at village Baghra, Tahsil Pandariya. Order has been issued for the construction of Canal under the scheme of Regabod-Kunda Project and the land of the petitioner situated at village Baghra was to be acquired under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 on
26.04.16. Accordingly, the notification has been issued whereby the khasra numbers as aforementioned are going to be acquired. Notice has been issued to the petitioner regarding acquisition of his lands. The report has also been submitted regarding the type of land whereby the land of the petitioner was irrigated land.
The award has been passed on 11.09.17 in case no. 05/ A /82 Year 2015-16 wherein also, the land of the petitioner has been shown as irrigated land. Even in the land records, the land of the petitioner are shown as irrigated land but while the award was paid by the respondent no.3, the land of the petitioner has been shown as non-irrigated land and the award has been paid accordingly. The petitioner approached the respondent no.3 and to the Collector but till date no action has been taken. Hence this Petition. 4. After arguing for some time, learned counsel for the petitioner submits that this
3 Writ Petition may be disposed of with a direction to the respondent authorities to decide his pending representation (Annexure P/8) in an expeditious manner within a stipulated time frame. 5. Considering the limited prayer made by counsel for the petitioner, this Court deems it appropriate to direct the petitioner to approach competent authority of respondents along with copy of this order within 15 days from the date of receipt of copy of this order and in turn, the said authority shall consider and decide the representation (Annexure P/8), if not decided, within a further period of 60 days. Ordered accordingly. 6. With the aforesaid direction, this Writ Petition is disposed of. Sd/-
